Unauthorized use of my work

Journal Entry: Sun Aug 17, 2014, 2:53 AM
Well, I found that one of my photos is being displayed and offered for free downloads on a site called VK.com, which states: "VK is the largest European social network with more  than a 100million active users." I sent them an email telling them they don't have my permission to display or offer my work for downloads and to take my work down immediately.

This is a photo that a person on Face Book was passing off their own work in a club called Black and White Photography. When I confronted the person they refused to give me credit or take my photo down. They were very insulting and obnoxious and insisted that they weren't doing anything wrong.  I contacted FB and the admin of the club and was completely ignored.  I kind of think she probably is the one responsible for this posting. Her attitude was that she left my signature intact on the photo so it was ok for her to do whatever she wanted with it. My signature isn't really noticeable unless you enlarge the photo. I've stopped posting in any clubs on FB that don't have admins I actually know because of this incident. She was so nasty and arrogant with me. She obviously wanted attention and compliments for work that didn't belong to her.

This site has a section called Wall with lots of artwork.  I wonder how much of it actually has the permission of the artist for display/downloads. I totally understand that is the risk when posting work online, but it still makes me angry.

Uh. I can totally understand your anger about this, offering for free downloads the photographs taken by others, how sweet!
Did they take your work down?
If not, I don't know what you can do because all of this is happening outside of Deviantart.

About the FB girl she is just one more attention w... BUT I think you can and should contact the Facebook staff on this issue. The official Facebook admins could help you on that one I think.

Yep, very nice of them! I'm not sure, when I try the link now everything shows but the photo. It may be that you have to be a logged in member to see it or they took it down. I sent them several emails without any real answer. For sure.

It sure seems that way. I sent messages and emails to FB and they never answered me. I also contacted the FB admin for that club and she didn't answer me either. The odd thing is later on she was offering the club for sale with no mention of price - not sure how that works.

See Peggy, these are all the reasons I am glad of having deleted my FB account...

But what about the big boss FB admin?
Not the club admins, the FB staff boss himself, the one whose rank and job is also to make sure all other admins are doing things right?

What about the terms of service of Facebook? They should inform you if what happened to you there is considered an infringement or not on FB.( If its not an infringement of any of their rules... Facebook is even worse than I thought then!)

Could you contact Mr Big Boss Admin himself on Facebook? I was thinking about him or her, not a "simple" club admin.

Hope you get to solve this, cheers

Well, you could be right about that. I just did some google image searches of my work and there's quite a bit of it all over the place. I was really shocked to see blogs that included  10 or more of my photos. They did identify me as the artist and some included my DA address. I think we don't have much control over our work, once it's  posted online.

I'm not sure and guess I will have to dig deeper to find out. Even finding an email address took some effort. They do have a copyright infringement action but I hesitated to use it as she did leave my signature on the photo - kind of makes things a bit murky.

Thanks! After looking around online this almost seems a bit overwhelming.

I'm not a photographer, just only a dreamer inside a camera lens.
Read this frankly to experience a true photographer bother.
These people can only be likened to mercenaries and nothing more.
I'm disappointed because today your sad experience dear Peggy is the reality of each of us.
A warm hug of solidarity.

Father Ambrose

Padre Ambrogio

The worst thing is that whereas you can search by image on google to see where else your photos have been posted, it doesn't cover facebook. So people could have posted our photos there and we wouldn't even know it unless we personally saw it on facebook :/

This attitude sucks, that's for sure :(
I gotta say one thing though, when I look at your photo, I see you have your share function enabled
So people can legally share your photo on face book, twitter, etc.
Above the ''add to favorites'' button, there are these little icons, if you click them, people 'share' your work
on these social networks, actually there doing nothing wrong according to dA policy.
I know this sucks, but you can disable this function, while you submit your art, or just click ''edit'' (the button next to 'delete'
under  ''select gallery'' there's ''options''  click on ''publishing options'' and you can choose to hide the sharing
buttons, and set the creative common license etc.

I know this won't stop art thieves, but at least they're doing something wrong spreading your work, which makes you
stand stronger in case you want to call on their behavior in any way.

You, sadly, hear these stories all the time. I agree with CinereusOculi. Watermark is a pity. If someone wants to edit, no hi-res. If someone manage to make money out of it (I mean a lot), then you can start hunting.

I don't add a watermark. I feel if someone wants to use it, at least give me credit ie: Photo credit: ThisDude@deviantArt.com
If they are going to steal it, and if they want to badly enough they will crop or edit etc., at least they are not getting the hi-res version! *laughs at them*

I don't get the mental process that allows someone to experience positive strokes regarding work that they had nothing to do with.  Am I malfunctioning, or is there actually some incomprehensible level of obtuseness that I am simply not able to reconcile with a functional reality?

I'm very sorry to hear that. Have you tried to contact Facebook through their "Contact Us" and see if they can do anything about it? Maybe there's a way to report it, you could report it offensive or something so it gets blocked...

I'm sorry your work has been pirated. Thieves hurt everyone and it's times like these that I wish I knew a really good hacker that could go in and pull down 'recovering' the digitally stolen work. Hope your able to make progress in taking it down.

I'm curious though, how did you find the image posted there?

For sure Alan. My work is signed but I guess I'll have to consider a large watermark. I did a Google image search and that result came up.

Unfortunate for sure Peggy.
One of the main reasons I hate sharing my artwork online to begin with.
I have basically succumb to the fact, that it's the "nature of the beast."
